    It would seem that the address to the problem of raiding by the first official of Buryatia should reassure the affected entrepreneurs, as well as public figures who are trying to protect their interests. However, their reaction to the statements of Vyacheslav Nagovitsyn was, to put it mildly, restrained.

    “We believe in the sincere concern of the head of the republic, but we believe that in the fight against raiding it is senseless to appeal to the law enforcement agencies of Buryatia,” the Center for Business Protection and Anti-Corruption Public Organization told our correspondent. – Any real result can be expected only if federal structures from the center take up the investigation of raider seizures.

    What’s the matter? Why do members of the public have such a skeptical attitude towards the law enforcement structures of the republic, while the Ministry of Internal Affairs of Buryatia even created a special department to combat raiding?


    Continuing the friendship of the fathers

    Today in Buryatia, and not only in Ust-Orda, these two surnames are closely connected by popular rumor. Of course, we are talking about the sons: the prosecutor of the republic Valeria Petrov and the Irkutsk businessman, the deputy of the regional Legislative Assembly Vladimir Dmitriev. The electronic newspaper Vek quite unambiguously calls the first “business prosecutor”, directly pointing out that with his appointment in 2006, “the prosecutor’s office began actively intervening in disputes between business entities in order to protect the interests of people close to the prosecutor.” With the name of the second press of Buryatia, they associate the most high-profile raider stories, in which the law enforcement agencies of the republic either show flagrant inaction, or, on the contrary, activity reaching the point of vanity. Apparently, depending on which of these positions is more interesting to the prosecutor’s fellow countryman.


    Invaluable help

    Not only the “power” structures of Dmitriev’s business empire, but also those who direct them, have become immune to the law enforcement agencies of Buryatia. A classic example is the termination of a criminal case on the facts of illegal withdrawal of property and the subsequent bankruptcy of Taryan OJSC, one of the Ulan-Ude bakeries.

    A group of persons constantly involved in Dmitriev’s operations entered the board of directors of this enterprise and elected Alexander Zholobko as CEO. For a complete understanding of the situation, let us say that Zholobko is the executive director of Narodny LLC, and also acts as a “representative of UNGA Management Company CJSC in Ulan-Ude”.

    Another decision of the newly made board of directors was the re-registration of the legal address of Taryan OJSC from Buryatia to Irkutsk. Specifically – on the street. Dzerzhinsky, 1. Many firms controlled by Dmitriev are registered at this address. Why did you need to re-register a bakery located in another city to this address? It can be assumed that in order to create additional conveniences in the subsequent bankruptcy.

    And, finally, most importantly, the board of directors consisting of Dmitriev’s people made a decision to sell seven production buildings of Taryan OJSC to a certain Capital CJSC, headed by another member of the large business family L.N. Dmitrieva. Moreover, the property was sold, which, according to the decision of the Arbitration Court that entered into legal force, was subject to collection in favor of another enterprise – Buryatkhlebprom OJSC, which, incidentally, is also a shareholder of Taryan OJSC (27% of shares).

    The contracts for the sale and purchase of the Taryanov buildings were apparently concluded retroactively. Unless, of course, we exclude the presence of a time machine in addition to the Robinson helicopter at UNGA Management Company CJSC. The fact is that on June 29, 2007, Dmitriev’s people, who stood at the management of Taryan OJSC, received information about the alienated real estate objects (areas, letters, etc.) from the Federal State Unitary Enterprise Rostekhinventarizatsiya. But somehow, miraculously, this data was included in sales contracts dated June 11, 2007. Why this particular date? The answer, in our opinion, is obvious: in order for the transactions to be formally concluded before the commencement of enforcement proceedings by the decision of the Arbitration Court in favor of Buryatkhlebprom OJSC.

    This was followed by the usual chain of resales in such cases: CJSC Capital sold the real estate to LLC ONOT, and it, in turn, LLC Avisma-Invest. You can’t say anything, conscientious purchasers!

    It is curious that, at the same time, Kapital CJSC did not immediately settle accounts with Taryan OJSC, but only after the bankruptcy was declared and the monitoring procedure was introduced in relation to the Ulan-Ude bakery. As a calculation, a bill of Sberbank with a face value of 10.5 million rubles was transferred, which the general director of Taryan OJSC Zholobko, to the detriment of the legitimate interests of other creditors, redirected to pay off the debt to Baikal-Bator LLC for “legal services”. The origin of this debt seems very strange, not to say doubtful. According to the agreements, LLC “Baikal-Bator” provided OJSC “Taryan” with these very “legal services” in 2005 for the amount of 22 million rubles! Although the entire balance sheet of Taryan OJSC for 2005 is about 13 million rubles …

    In 2010, a criminal case was initiated on the facts of all the above-described manipulations. But the investigation did not last long – already in October of the same year it was stopped “due to the absence of corpus delicti in the act of unidentified persons”. The intervention of the Plenipotentiary Representative of the President of Russia in the Siberian Federal District A.V. Kvashnin. The case was only formally reopened for several days, which, apparently, was reported to the Plenipotentiary, and then it was closed without any real investigative actions and with the same wording. After that, all the materials were requested by the prosecutor’s office of Buryatia.

    For the sake of justice, we note that the prosecutor’s office of Buryatia is showing strange complacency not only towards Dmitriev and his entourage. They say that, not without the participation of the leadership of the supervisory authority, the criminal case initiated against the director of LLC Kyakhtinskoye S.N. Chursov under part 2 of article 159 of the Criminal Code of the Russian Federation, despite the fact that the damage amounted to 31 million rubles. Moreover, we are talking about federal funds aimed at modernizing the pig breeding complex of LLC Kyakhtinskoye within the framework of the priority national project “Development of the agro-industrial complex”.



    On the other hand, when necessary, the law enforcement agencies of Buryatia are able not only to initiate criminal cases, but also to extend the period of investigation up to several years. A living example is the criminal case against the leadership of the Yubileiny TD. It has been going on for three years and, in our opinion, is openly used to put pressure on the owners, from whom Dmitriev and his comrades, having seized 42% of the shares through cunning manipulations, are seeking to transfer a controlling stake to him.

    As part of the criminal case, an operation was carried out, the result of which was the transfer of the building of the Trade House “Yubileiny” for “safekeeping” to the company “Danak”, and in fact – under the control of Dmitriev’s people. The prosecutor’s office did not say a word.

    Indeed, would an investigator have dared to take actions that are unequivocally regarded by the public as a “corruption scheme” if he had not received blessings from the very top of the law enforcement system of Buryatia?

    The capabilities of the state power structures were also used by Dmitriev’s “brigade” in the acquisition of JSC “Auto”, against whose leadership a criminal case was also opened. The persecution ended only after the besieged enterprise came under her full control. On its territory Dmitriev opened a commercial registration point for vehicles “Agat”, which is connected with another scandalous criminal case.

    In the spring of this year, Ulan-Ude was shocked by the news that the head of the traffic police of Buryatia, Colonel Alamzhi Syrenov, a military officer who passed through Chechnya, was always respected by his colleagues and ordinary citizens, was brought to criminal responsibility and dismissed from office. He turned out to be a defendant in a scandalous criminal case on the legalization of illegal vehicles through a traffic police unit in the suburban village of Onokhoy. The irony of fate lies in the fact that Syrenov himself contributed to the exposure and prosecution of corrupt employees of the unit, which, by the way, reports directly to Moscow. It is clear that some of the defendants easily agreed to testify against the colonel.

    Meanwhile, veterans and Interior Ministry officers who defended Syrenov believe that the reason for his persecution could have been the refusal of Dmitriev’s request to increase the number of traffic police officers at the Agat commercial registration point in order to increase the turnover and profit of this private enterprise. Then, possibly, the mechanism worked out in the course of raider operations was launched.

    Vasily Ustinov, the general director of a large wholesale base Rosich in Ulan-Ude, believes that criminal prosecution was also being prepared against him. Since March of this year, people, it seems, were people from Dmitriev’s group (including Artemy Kritsky, former director of the Department of Deposits and Loans), are buying up shares of the enterprise, misleading shareholders (former and current employees of the base) with stories about the fact that the shares will be listed on the stock exchange, and this will attract large investments. Somehow, the buyers took possession of confidential information about the number and type of shares owned by each shareholder, and the personal data of citizens.

    Ustinov appealed to the Investigative Committee and the FSB of Russia. Soon after the application was sent, a large fire broke out at the base, about 3 thousand square meters burned out. meters of warehouse space, the goods were destroyed.

    Ustinov claims that, according to eyewitnesses, some people were taking photographs of warehouses, where a fire then occurred. He does not exclude that the cause of the fire could have been arson with the aim of subsequently initiating a criminal case against the CEO for negligence or something like that. It is no coincidence, Ustinov emphasizes, that the Minister of Internal Affairs of Buryatia Zaichenko personally came to the fire, who, in general, has nothing to do with the fire brigade.

    It was about such situations that Dmitry Medvedev spoke: “It is also necessary to pay attention to the fact that those who are called upon to protect against raiding do not themselves join the raider brigades.”

    But in Buryatia these words are not heard. The President of Russia is far away, but the “business prosecutor” is close.


    Investor or Destroyer?

    In his public speeches in Buryatia, Vladimir Dmitriev positions himself as an “investor”. Apparently, the Selenga bus station was to become a vivid example of his investment activity, which, after several postponements of the commissioning date, nevertheless opened on January 17 this year. However, “a small building that looks more like a hastily erected shopping boutique” was empty for a long time, and until now a significant part of the regular buses going to the regions of the republic prefer to stay away from Dmitriev’s creation.

    The fact is that the bus station built by him is located on the former territory of the shipyard, far from the main transport routes of the city. But most importantly, for the service at the bus station, the drivers of intercity buses were demanded such a fee, which they considered completely unacceptable. And only after long negotiations and concessions, some of the carriers agreed to cooperate with the bus station.

    What was the “investor” counting on when starting the construction of a bus station in an inconvenient place and not having agreed in advance with the carriers?

    Some sources in Ulan-Ude believe that the bus station was needed by Mr. Dmitriev in order to soften the very tough position of the republican authorities regarding the “development” of the industrial zone of the shipyard. In 2008, the President of Buryatia, Vyacheslav Nagovitsyn, sharply criticized Dmitriev’s plans to build an elite residential complex there. The head of the republic said about the need to attract investors who, “unlike the current owners, understand the strategic location of the plant and will certainly not consider the city-forming enterprise as an opportunity to get quick and easy money.”

    However, the destruction of the industrial zone continued. With the only amendment that instead of elite housing, rag markets appeared, and as “social projects” – a commercial clinic and a bus station.

    According to other sources, during the construction of the bus station, the calculation was made on the fact that the submissiveness of the carriers will be ensured by the Ulan-Ude authority Vladimir Vlasko, known in the city as “Khokhol”. However, in October 2010, Vlasko was shot and killed along with his bodyguard driver at the entrance of his house. After the murder, the newspapers of Buryatia wrote that “the authority cooperated with the Irkutsk businessman, who is known precisely as a raider, who also has interests in Ulan-Ude.” Who we are talking about is easy to guess …


    Looking through your fingers

    There is information that shortly before the death of Vlasko, he showed interest in the largest deposit of white jade in Buryatia, which the Chinese are willingly buying for currency. Coincidence or not, the spring of 2010 witnessed events worthy of a western-style action movie in this field. The newspaper “MK” in Buryatia “wrote:” On May 16, a group of armed people arrived at the Medvezhiy jade quarry in the Bauntovsky district in the Kavokta area, blocking the security of the miners of the Dylacha family-clan community and openly engaged in predatory extraction of jade … When the guards tried to obstruct the prey, the bandits beat up two guards and shot the dog. On the same day, a telephone message about the bandit attack was received in Ulan-Ude, but the Ministry of Internal Affairs did not take any operational measures in the Republic of Belarus. Only three days later, on the morning of May 19,

    From private to federal

    The vulnerability of private property gives raiders an appetite. Impunity unties the hands that reach for the most delicious morsels – state and federal property.

    In 2010, the Barguzinsky District Court, and then the Supreme Court of the Republic of Buryatia, ordered Dmitriev to release the unauthorizedly seized lands that are in federal ownership on the territory of the Trans-Baikal National Park on the eastern coast of Lake Baikal. The court established that unauthorized construction began in August 2008 in the area of ​​Bolshoy Chivyrkuy. A large number of building materials have been delivered. In this regard, the leadership of the Zabaikalsky National Park, the territorial body of Rosprirodnadzor have repeatedly issued orders to stop illegal activities, and initiated cases of administrative offenses. But the contractor continued construction work, referring to the fact that he was hired by the entrepreneur Dmitriev and he is acting on his instructions.

    The court ordered Dmitriev to demolish the unauthorized buildings and take out all the building materials outside the Zabaikalsky National Park. The decision came into legal force.

    However, Dmitriev publicly stated that he intends to obtain permits and resume construction in a specially protected natural area. We believe that this can be done only through corruption …

    Who helped hide the evidence?

    In February of this year, a very strange incident occurred in Ulan-Ude. A group of law enforcement officers from Irkutsk arrived in the capital of Buryatia. We have arrived, we note, not for the sake of idle curiosity, but for carrying out investigative and operational measures in the framework of a criminal case of fraud – the seizure of a large federal property in Irkutsk. There was a need to check for involvement in this crime two firms registered in Ulan-Ude on Korabelnaya street, 32.

    However, the “chopovtsy” guarding the office building refused to let the Irkutsk investigators inside. There was a conflict. The Irkutsk people quite logically decided to turn to their Ulan-Ude colleagues for help. Indeed, on their side was the Law, which, as it is believed, is the same for everyone and throughout Russia. Representatives of the Ministry of Internal Affairs of Buryatia arrived at the scene and helped to get to the offices. However, the security of the building cut off the electricity, and then the Buryat police officers received an order by phone to immediately stop participating in the operation and not to assist the Irkutsk investigators. As a result, the latter were forced to leave the building, convinced from their own experience that a very peculiar understanding of the thesis about the unity of the legal field in Russia took root in Buryatia. And a criminal case on embezzlement of federal property can now come to a standstill if important evidence disappears, which,

    And now, taking into account all of the above, we will ask ourselves the question: is it worth, knowing all of the above, to expect a miraculous insight from the leadership of the prosecutor’s office and the Ministry of Internal Affairs of Buryatia after the public appeal of the head of the republic Vyacheslav Nagovitsyn to them regarding the fight against raiding? Or is it the same as asking the cat to watch the sour cream and the bees to give up honey? And is there any other option?
